Terms of Use & Service Agreement

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you ("User", "Client", or "Licensee") and TVB Network (Pty) Ltd ("TVB Network", "we", "us"). By accessing tvbnet.co.za or any associated software product (BuildPro, EduManage, FieldControl, MediCore, MineCore, PropManage SA, ProSecure, SupplierPro, TransFleet), you confirm your acceptance of these terms.

2. Provision of Software & Services

TVB Network provides custom software development, mobile application development, UX/UI design, cloud infrastructure engineering, and SaaS platforms. Specific project deliverables, timelines, and payment terms are governed by executed Master Services Agreements (MSA) and Statements of Work (SOW).

3. Intellectual Property Rights

All proprietary algorithms, source code, visual designs, trademarks, logos, and documentation created by TVB Network remain the exclusive intellectual property of TVB Network (Pty) Ltd, unless explicitly transferred under written contract upon full payment of agreed fees.

4. User Responsibilities & Acceptable Use

When using our services or account portals, you agree not to:

• Attempt unauthorized access to system infrastructure, user accounts, or private databases.
• Reverse-engineer, decompile, or copy platform source code or proprietary architecture.
• Transmit malicious code, automated scrapers, or launch denial-of-service (DoS) attacks.
• Violate any applicable South African laws, including the Cybercrimes Act 19 of 2020 and POPIA.

5. Pricing, Quotations & Payment Terms

All project quotes are issued in South African Rand (ZAR) and valid for 30 days unless stated otherwise. Milestone payments, deposit structures, and retainer schedules are outlined in individual project proposals.

6. Limitation of Liability

To the maximum extent permitted by South African law, TVB Network (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential damages resulting from platform downtime, data loss, or reliance on information provided on our website. Our total cumulative liability shall not exceed the total amount paid by the Client in the preceding three (3) months under the relevant service agreement.

7. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any legal proceedings or disputes arising under these terms shall be submitted to the exclusive jurisdiction of the High Court of South Africa (Gauteng Local Division, Johannesburg).
